What is Paraquat?

Paraquat dichloride, commonly referred to as "paraquat," is one of the most widely used herbicides in the United States. According to the EPA, paraquat dichloride is one of the most widely used herbicides in the United States. It's a non-selective, quick-acting herbicide that has been available since 1962.

Common Brand Names:

  • Gramaxone
  • Parazone
  • Quik-Quat
  • Firestorm
  • Helmquat

Key Facts About Paraquat:

  • Highly toxic herbicide used to kill weeds and grasses
  • Paraquat use has long been restricted to certified applicators, mainly due to concerns based on studies of animal models of Parkinson's disease.
  • Banned in over 30 countries, including the European Union
  • The EPA's website warn,s "One Sip Can Kill"

Is There a Link Between Paraquat and Parkinson's Disease?

Multiple scientific studies have found a connection between Paraquat exposure and Parkinson's disease, despite ongoing debate in the scientific community.

Key Research Findings:

NIH Study Results: New research from the National Institute of Environmental Health Sciences (NIEHS) shows a link between the use of paraquat and Parkinson's disease. People who used the pesticide developed Parkinson's disease approximately 2.5 times more often than non-users.

Animal Studies: Along with a pesticide known as Rotenone, Paraquat is routinely used to induce Parkinson's disease for studies in animals, according to the Parkinson's Foundation.

Historical Evidence: Nearly 60 years ago, a chemical company found that skin exposure to very high doses of its weedkiller paraquat caused "weakness and incoordination" in rabbits. Large amounts of the herbicide caused some mice and rats in its labs to develop a stiff gait or tremors.

How Paraquat May Cause Parkinson's:

"Paraquat increases production of certain oxygen derivatives that may harm cellular structures. People who used these pesticides or others with a similar mechanism of action were more likely to develop Parkinson's disease," said Freya Kamel, Ph.D., a researcher at NIEHS.

Who Was Exposed to Paraquat?

Licensed Applicators:

  • Commercial farmers
  • Agricultural workers
  • Landscaping professionals
  • Pesticide applicators
  • Groundskeepers at golf courses

Secondary Exposure:

  • Family members of applicators
  • Workers at farms using Paraquat
  • Residents living near treated areas
  • People visiting national wildlife refuges (where Paraquat is used)

Important Note:

There are no home garden or residential uses for paraquat currently registered, according to NIH. However, many people were exposed through their work or by living near areas where it was applied.

What is Parkinson's Disease?

Parkinson's disease is a progressive neurodegenerative disorder that affects movement and can significantly impact quality of life.

Common Symptoms:

  • Tremors - especially in hands, arms, legs, jaw, or head
  • Rigidity - stiffness of the limbs and trunk
  • Bradykinesia - slowness of movement
  • Postural instability - impaired balance and coordination
  • Speech problems - soft or slurred speech
  • Writing changes - small, cramped handwriting

Disease Progression:

Parkinson's disease is progressive, meaning symptoms worsen over time. While there is no cure, treatments can help manage symptoms and improve quality of life.

What Makes Paraquat So Dangerous?

Extreme Toxicity:

The EPA acknowledges that paraquat is extremely dangerous, with its website stating, "One Sip Can Kill." This refers to the immediate toxicity, but long-term exposure may be linked to Parkinson's disease.

Banned Worldwide:

Due to safety concerns, paraquat has been banned in over 30 countries, including:

  • All European Union countries
  • China
  • Switzerland
  • United Kingdom

Yet Still Used in the U.S.:

Despite health concerns and bans elsewhere, the EPA released an interim decision in July 2021 allowing continued use of paraquat with additional mitigation measures.

Why Are People Filing Paraquat Lawsuits?

Manufacturer Knowledge:

Research suggests that paraquat manufacturers may have known about potential health risks for decades. A decade after initial animal studies, an autopsy of a farm worker exposed to paraquat showed "degenerative change" in the "cells of the substantia nigra," a pathological hallmark of Parkinson's disease.

Failure to Warn:

Lawsuits allege that manufacturers:

  • Failed to adequately warn users about Parkinson's disease risks
  • Downplayed scientific evidence linking Paraquat to Parkinson's
  • Continued marketing the product despite knowing the dangers
  • Failed to develop safer alternatives

Scientific Manipulation:

Some evidence suggests manufacturers may have attempted to influence regulatory decisions and attack scientists studying Paraquat's health effects.

Do I Qualify for a Paraquat Lawsuit?

You may qualify if you meet these criteria:

Exposure Requirements:

  • Used Paraquat directly (mixing, loading, applying)
  • Worked on farms where Paraquat was used
  • Lived near areas where Paraquat was regularly applied
  • Exposure occurred for months or years (not just one-time)

Medical Requirements:

  • Diagnosed with Parkinson's disease by a qualified physician
  • Diagnosis occurred after Paraquat exposure
  • Medical records documenting your condition

Time Requirements:

  • Exposure typically occurred between 1960s-present
  • Parkinson's diagnosis usually comes years after initial exposure
  • Each state has different deadlines for filing lawsuits

Important: Even if you're not sure about the exact timing or extent of your exposure, contact an attorney for evaluation.

What Compensation May Be Available?

Economic Damages:

  • Medical expenses (past and future treatment costs)
  • Lost wages from inability to work
  • Reduced earning capacity
  • Home modifications for disability
  • Assistive devices and equipment

Non-Economic Damages:

  • Pain and suffering from Parkinson's symptoms
  • Loss of enjoyment of life
  • Emotional distress
  • Loss of consortium (impact on relationships)

Punitive Damages:

  • Available if manufacturers acted with gross negligence
  • Designed to punish wrongdoing and deter future misconduct

How Are Paraquat Cases Being Handled?

Multi-District Litigation (MDL):

Most Paraquat lawsuits are consolidated in federal court to streamline the legal process while preserving individual rights to compensation.

Individual Case Evaluation:

While cases are coordinated, each person's injuries and exposure history are evaluated individually to determine appropriate compensation.

Bellwether Trials:

Select cases go to trial first to help establish value ranges for settlements.

What Evidence Do I Need?

Exposure Documentation:

  • Employment records from farms or agricultural companies
  • Pesticide application records
  • Training certificates for pesticide use
  • Witness statements from coworkers

Medical Evidence:

  • Parkinson's disease diagnosis
  • Medical records and treatment history
  • Neurologist evaluations
  • Brain imaging studies (if available)
